On October 15, 1987 defendant, Ronald Smith, was charged with armed robbery and attempted first degree murder. LSA-R.S. 14:64; 14:27(30). A jury found him guilty as charged on both counts. Defendant filed a motion for a new trial. He was then sentenced to 35 years of hard labor on each count and moved for an appeal.
