This products liability action arose out of an accident occurring on May 24, 1985, in which the plaintiff, Jimmy Wayne Davis, Sr. (Davis), was struck in the right eye by a strap used to tie down a tarpaulin. On April 9, 1986, this litigation was instituted against Crow Burlingame, retailer, and Radiator Specialty Company (Radiator Specialty), a manufacturer of tarpaulin straps.
