1. Introduction.

The state of Texas plans to execute Harris for the murder of Tim Merka in 1978. After convicting him of capital murder, the jury sentenced him to die. On appeal, the Texas Court of Criminal Appeals reversed his conviction and remanded for a new trial. At his second trial, a jury again found Harris guilty and sentenced him to death.
