GILLETTE, Justice.

This is a proceeding under ORS 183.4001 to determine the validity of two temporary rules adopted by the Workers' Compensation Division of the Department of Insurance and Finance (the Department). The Court of Appeals held that the challenged rule had been superseded by a later rule, and so declared the proceeding moot and dismissed it. We allowed review and now affirm the decision of the Court of Appeals.
