The State of Delaware seeks the issuance of a writ of mandamus to compel the Superior Court to resentence a defendant under certain assessment standards which were not in effect when the offense was committed. The State specifically requests this Court to order the Superior Court to impose a three percent increase in the amount to be paid by the defendant, Carl E. Smith ("Smith"), to the State's Victim Compensation...
