On May 7, 1990 the defendant was charged with possession of cocaine, a violation of R.S. 40:967(C)(2). He was tried by jury on July 16, 1990 and found guilty as charged. He was sentenced on July 23, 1990 to forty months at hard labor with credit for time served. He was subsequently adjudged a second felony offender. The original sentence was vacated and the defendant re-sentenced as a second felony offender on August 17, 1990 to forty months at hard...
