This is an appeal from the trial court's order granting the Board of Trustees of the Firemen's Annuity Benefit of Chicago's (Board's) motion to dismiss plaintiffs' complaint for declaratory judgment seeking to declare section 6-210.1 of the Firemen's Pension Code (Ill.Rev.Stat.1989, ch. 108½, par. 6-210.1) unconstitutional under article XIII, section 5 of the Illinois Constitution.
