The facts of this case are tragic. A second grader was killed when a gate located on school grounds swung in front of the van in which he was a passenger, pierced through the vehicle, and impaled the child. The question presented is whether one of the defendants, the assistant principal at the school, was entitled to a summary judgment on the grounds that there was no showing that any negligence on his part...
