Plaintiff, William Myers, brought this action against Putzmeister to recover damages for injuries he sustained while operating a cement pump which was manufactured by Putzmeister's predecessor. Putzmeister had purchased the assets of the predecessor pursuant to a sales agreement and bankruptcy court order.
