James Pierce pleaded guilty in the district court to one count of possession with intent to distribute cocaine. 21 U.S.C. § 841(a). Pierce filed a timely notice of appeal. While his direct appeal was pending, Pierce obtained new counsel, who filed a motion under 28 U.S.C. § 2255 to vacate Pierce's sentence.
