This cause of action arises from a rear-end automobile collision that occurred on November 14, 1987, involving plaintiff, Stanislaw Rerack, and defendant's decedent, Daniel J. O'Leary, on Diversey Avenue near Harlem Avenue in the City of Chicago. O'Leary, the initial defendant to this suit, died of causes unrelated to the accident during the pendency of this case.
