This is an appeal from a grant of summary judgment in favor of the defendant, Eastern Associated Coal Corporation, and against the plaintiff, Craig E. Raber, by the Circuit Court of Marion County. Mr. Raber brought this action against Eastern Associated Coal Corporation alleging age discrimination in his layoff and Eastern's subsequent failure to rehire him.
