MABE v. COM.

Record No. 0245-91-3.

417 S.E.2d 899 (1992)

Richard James MABE v. COMMONWEALTH of Virginia.

Court of Appeals of Virginia.

May 12, 1992.

Attorney(s) appearing for the Case

R. Wayne Austin (Johnson, Scyphers & Austin, on brief), for appellant.

Thomas C. Daniel, Asst. Atty. Gen. (Mary Sue Terry, Atty. Gen., on brief), for appellee.

Present: BAKER, COLEMAN and WILLIS, JJ.

WILLIS, Judge.

Richard James Mabe, the appellant, was convicted of escaping from the Washington County Jail in violation of Code § 53.1-203(1) and was sentenced to two years imprisonment. He contends that the trial court erred in finding him guilty under Code § 53.1-203(1). He argues that he could be found guilty of no more than a Class 2 Misdemeanor under Code § 53.1-131. We find no error and affirm the decision of the trial court.
