OPINION

ROBERTSON, Judge.

Appellant appeals from orders granting appellee's motion for partial and final summary judgment and the denying of appellant's motion for partial summary judgment. Appellant challenges the trial court's ruling on whether the commission agreement contained a condition precedent and the award of attorneys fees. We reverse.
