This is an interlocutory appeal by the State of Texas pursuant to Tex.Code Crim. ProcAnn. art. 44.01(a)(5) (Vernon Supp. 1992). The state indicted David Tees, Chester Clouse, Jr., Jesse Gurley, Russell Moore, and Terri Clouse, for the first degree felony offense of engaging in organized criminal activity.
