This is an appeal from an order granting summary judgment to the State of Idaho and against Forrest Wimer and Jack Hodge. Wimer and Hodge brought an action under the Idaho Tort Claims Act (ITCA) for damages against the state and two officers of the Department of Fish and Game, Mel Hedberg and William Snow, after the plaintiffs were investigated for killing elk illegally in Idaho County. No charges were filed against Hodge as a result of the investigation...
