Joseph Pantoja, a member of Teamsters Local Union No. 705 in Chicago, sued Holland Motor Express, Inc. (Holland), alleging that Holland's refusal to rehire him after he was involved in a trucking accident violated its collective bargaining agreement (CBA) with the union and amounted to a retaliatory discharge under Illinois tort law. The district court granted Holland summary judgment on both claims, finding that the CBA claim was time barred...
