The defendant, Albert Mickey, Jr., was originally charged by grand jury indictment with first degree murder, in violation of LSA-R.S. 14:30. Subsequently, the charge was amended to second degree murder, a violation of LSA-R.S. 14:30.1. He pled not guilty and, after a trial by jury, was found guilty of the responsive offense of manslaughter, a violation of LSA-R.S. 14:31.
