OPINION

OLIVER-PARROTT, Chief Justice.

This Court is asked to determine whether the trial court properly granted a summary judgment in favor of appellee, Board of Trustees, The City of Houston Firemen's Relief and Retirement Fund. We find that it did and affirm the judgment of the trial court.
