Plaintiff IMAF, S.p.A. ("IMAF") brought this case in 1986 alleging breach of contract, tortious interference with contract, trademark infringement, and unfair competition by defendant J.C. Penney Company, Inc. ("Penney"). IMAF initially brought suit in state court, and the case was removed to federal court because of trademark claims based on the Lanham Act, 15 U.S.C. § 1051 et seq.
