This court's original opinion, dated March 20, 1992, is withdrawn, and the following is substituted therefor:

Andrew J. Kaufman and William J. Wilkens, Jr., entered into a contract, in which Kaufman agreed to purchase certain real estate from Wilkens at the price of $3 per square foot. Kaufman paid $5,000 as earnest money, which would be forfeited as liquidated damages...
