Plaintiff-appellant Village of Winnetka (the Village) brought this action for judicial review of the Industrial Commission's decision which, confirming the Arbitrator, found that section 22-307 of the Illinois Pension Code (Ill.Rev.Stat.1981, ch. 108½, par. 22-307) did not bar claimant Raymond Gherardini, a Winnetka fireman, from proceeding on his worker's compensation claim against the Village.
