On November 14, 1990, the defendant, Albert G. Green, Jr., was charged by bill of information with possession with intent to distribute a Schedule I CDS, a violation of La.R.S. 40:966 A(1). Originally, the defendant pled not guilty to the charge. However, after the trial judge ruled unfavorably on a motion to suppress, the defendant entered a guilty plea reserving his right to appeal the trial court's ruling under authority of State v.
