The state originally charged appellant with rape, and two months prior to trial, amended its information to allege appellant a habitual offender under Ark.Code Ann. § 5-4-501(b) (1987). Appellant was found guilty of rape, and at a subsequent hearing on whether appellant's sentence should be enhanced, the jury sentenced him to 100 years in the Arkansas Department of Correction.
