In this appeal we are faced with the question of whether the defendant's right to a fair trial was violated on retrial due to the publicity surrounding his first trial which had ended in a hung jury. Prior to retrial, Acting Chief Judge Brotman (who did not preside over the first trial) conducted voir dire of the venirepersons in his chambers and ascertained that each person who ultimately sat on the jury...
