Defendant, Frank M. Brown, was indicted for the second degree murder of Kenneth Dubois on March 4, 1989, in violation of La.R.S. 14:30.1 (case no. 89-1771F). He pleaded not guilty, and after a sanity commission hearing, was found competent to stand trial. He was tried by a twelve-person jury which returned a responsive verdict of guilty of manslaughter.
