This case is back before the Court on remand for resentencing. On July 16, 1990, Judge Richard Mills sentenced the defendant to 240 months imprisonment having decided an upward departure was warranted. The trial court initially determined an adjusted offense level of 24 (26 minus 2 for acceptance of responsibility) and a criminal history category of V, yielding a guideline sentencing range of 92-115 months of imprisonment.
