OPINION ON MOTION FOR REHEARING

O'CONNOR, Justice.

We withdraw our earlier opinion and issue this one in its stead. Baker & Botts, the appellee, filed a motion to dismiss the appeal on the grounds the appellant did not timely perfect his appeal. We find that the appellant did not timely file his appeal bond, we grant the motion to dismiss, and we deny the motion for rehearing.
