In this case the constitutionality of an ordinance of the City of Hot Springs has been challenged as being in violation of the First Amendment guarantee of freedom of speech. The ordinance regulates "sexually oriented businesses" in Hot Springs by setting qualifications for licensing and assuring geographic disbursement within the City.
