MEMORANDUM OPINION

MICHAEL, District Judge.

Nine defendants are charged with conspiracy to possess with intent to distribute and conspiracy to distribute cocaine and marijuana in violation of 21 U.S.C. §§ 841(a)(1), 841(b)(1)(B)(ii) and 841(b)(1)(D).

This court heard motions in this case on July 30, 1992 during which defendants Ernest Shifflett and Margaret Shifflett, pursuant to Brady v. Maryland, 373 U.S. 83
