FLAUM, Circuit Judge.

In the spring of 1985, Dan Lashmett (Lashmett) devised a scheme to secure insurance on fictitious livestock, report that fictitious livestock stolen, and collect on the insurance. One obstacle stood in his way: he was in state prison at the time (on charges unrelated to this suit), so he had to enlist the services of others to do the legwork for him. For that he turned to his son, Dan Jeffrey Lashmett (Jeff), and his son-in-law, Randy Smith ...
