On January 10, 1991, a jury convicted Agustin Cervante of knowingly and intentionally attempting to possess with intent to distribute approximately three kilograms of cocaine in violation of 21 U.S.C. § 841(a)(1). The district court denied Cervante's post-trial motion for judgment of acquittal notwithstanding the verdict or for a new trial and sentenced him to 78 months imprisonment followed by four years supervised release.
