OPINION

MURRAY, Justice.

This matter is before the Supreme Court on appeal by the defendant, James M. Tobin, Jr. (Tobin), from his conviction in the Providence County Superior Court. Tobin was found guilty of second-degree sexual assault, G.L. 1956 (1981 Reenactment) § 11-37-4, as amended by P.L. 1984, ch. 59, § 1. He was sentenced to twelve years imprisonment, all of which were suspended.
