This is an appeal from a judgment in favor of appellees in a breach of contract action. Charles N. Schwarz and A.L. De-Cell brought suit against Baker Hughes, Inc., and the case was tried before a jury. When the jury failed to reach a verdict, the trial court declared a mistrial; however, all parties moved to set aside the order and agreed to submit the case to the court for determination.
