This is an appeal by the defendant D.G.D., Inc. from (1) a final judgment entered after a non-jury trial in a breach of contract action which sought the recovery of sales commissions allegedly earned by the plaintiff Jason Berkowitz while employed as a sale representative for the defendant, an out-of-state company operating in New York City, and (2) a post-trial order awarding attorney's fees to the plaintiff as the prevailing party in the action.
