Defendant, Martez Colbert, was convicted of first degree murder (Ill.Rev.Stat. 1985, ch. 38, par. 9-1) and conspiracy to commit murder (Ill.Rev.Stat.1985, ch. 38, pars. 8-2, 9-1) in a jury trial. The trial court vacated the conspiracy conviction and sentenced defendant to 40 years imprisonment.
