On complaint and information, appellant was charged with the misdemeanor crime of driving while intoxicated—second offense. See Tex.Rev.Civ.Stat. Ann. art. 6701/-1 (Supp.1992). After trial to a jury, he was convicted and sentenced to one year in the county jail and fined $1000.
