This is a personal injury action, arising out of injuries incurred by plaintiff, Dennis Tierney, while working on property owned by defendant, Burlington Northern Railroad. Plaintiff sued for recovery under the Federal Employers' Liability Act (FELA) (45 U.S.C. § 51-60), which imposes liabilty upon railroads for the negligent death or injury of its employees.
