Before the Court are defendant's and intervenors' motions to dismiss plaintiff's complaint. Plaintiff's complaint arises from a case currently pending in the Third Judicial Circuit, Madison County, Illinois. In that action, plaintiff was served with a Notice to Appear pursuant to Ill.S.Ct.Rule 237(b). Ill.Rev.Stat. ch. 110A, ¶ 237(b).
