OPINION

MEYERS, Justice.

Appellant, Domingo Turro, appeals from a conviction by the jury of murder. See Tex.Penal Code Ann. § 19.02 (Vernon 1989). Punishment was assessed by the court at forty-five years confinement.

We reverse.
