Appellant, Donald Eugene Dutton, appeals his judgment for conviction of aggravated assault on a police officer. Tex.Penal Code Ann. § 22.02 (Vernon 1989). Appellant was charged in a two count indictment for aggravated assault on a peace officer and aggravated kidnapping.
