Appellant, Donald Eugene Dutton, appeals his judgment for conviction of aggravated assault on a police officer. Tex.Penal Code Ann. § 22.02 (Vernon 1989). Appellant was charged in a two count indictment for aggravated assault on a peace officer and aggravated kidnapping. The court granted the State's motion to sever the two counts of the indictment and the State proceeded to trial on the first count of aggravated assault on a police...
