This is an action commenced on September 9, 1988 by Plaintiff pro se, seeking relief under 42 U.S.C. §§ 1981 and 1983. Defendants move to dismiss the complaint pursuant to Fed.R.Civ.P. 12(b)(6). Plaintiff cross-moves for summary judgment pursuant to Fed.R.Civ.P. 56.
