We grant certiorari to consider the correctness of a trial court ruling finding defendant, Jerard C. Franklin, not to be a habitual offender.

Defendant was charged by bill of information with simple burglary, a violation of La.R.S. 14:62. On January 24, 1991, he entered a plea of guilty as charged and was sentenced to serve four years at hard labor with credit for time served.
