ERVIN, Chief Judge:

J.D. Miller violated the Change in Bank Control Act, 12 U.S.C. § 1817(j)(1), by buying a controlling interest in a bank without giving the required 60 days' notice to the Federal Deposit Insurance Corporation ("FDIC"). The FDIC assessed a civil money penalty, and the district court granted summary judgment in the FDIC's favor, ordering Miller to pay the same amount of penalty that the FDIC had assessed.
