Alan Dale Kolmetz was indicted for the offenses of murder, in violation of § 13A-6-2, Code of Alabama 1975, and assault in the first degree, in violation of § 13A-6-20, Code of Alabama 1975. On motion of the State, the two indictments were consolidated for trial. The jury found Kolmetz guilty of the lesser included offenses of manslaughter and assault in the second degree, and Kolmetz was sentenced to 16 years' imprisonment...
