The defendant, Joseph A. Finley, was charged by indictment with the felony offense of driving while under the influence of alcohol (DUI) pursuant to section 11-501(d) of the Illinois Vehicle Code (Ill.Rev. Stat.1989, ch. 95½, par. 11-501(d)). This section provides for enhancement of a DUI conviction to a class 4 felony when two prior DUI violations have been committed.
