Appellant shot his ex-wife, Paula M. Hubbard, in the presence of police officers at the parking lot of the McDonald's restaurant in Brinkley, Arkansas. Approximately one month after the shooting, the victim died and appellant was charged by amended felony information with murder in the first degree, a violation of Ark.Code Ann. § 5-10-102 (1987).
