Appellant Patrick Neal Gammon appeals the trial court's denial of his motion to suppress evidence, consisting of one "rock" of crack cocaine, seized in the course of a search incident to his arrest for the crime of shoplifting. Following the denial of his motion to suppress, Gammon waived his right to a jury trial and was tried for the crime of possession of cocaine. Gammon was found guilty of the crime charged.
