This action arises from the death of a longshoreman engaged in maritime employment on board a vessel, on navigable waters, and so is governed by the Longshore and Harbor Workers' Compensation Act (33 USC § 901 et seq.) and Federal maritime law (Tibak v City of New York, 154 A.D.2d 313, lv denied 75 N.Y.2d 705; Stuto v Coastal Dry Dock & Repair Corp., 153 A.D.2d 937
