The plaintiff, Arlene L. Dolcy (Arlene or plaintiff), is appealing the grant of summary judgment for the defendant, Rhode Island Joint Reinsurance Association (Association). Simply stated, the issue in this case is whether an innocent, noncollusive spouse may recover under a fire insurance policy issued to a husband and wife, on property held as tenants by the entirety, when the other spouse intentionally sets fire to the property...
